1    Introduction

Pitsch Fitnesscenter GmbH («Pitsch Fitness» or «we») is the operator of the website www.pitsch-fitness.ch («the website») and as such responsible for the collection, processing and use of personal data and for ensuring that this processing of personal data is compatible with the provisions of Swiss law.

On the basis of Article 13 of the Swiss Federal Constitution and pursuant to the Swiss Data Protection Act, each person has the right to privacy and protection against misuse of their personal data.

Pitsch Fitness adheres to the statutory provisions of the Data Protection Act, the Ordinance to the Federal Data Protection Act, the Telecommunications Act and other statutory provisions related to data protection.

Consequently, we have put together this Data Protection Declaration to inform you of how we treat personal data. This data is collected and used during use of the website within the following scope and for the following purposes:

2    Use of personal data

2.1    Transferral of personal data to third parties

We will only transfer your personal data to third parties if you have expressly permitted us to do so, where there is a statutory obligation, or where this is required for enforcement of our rights, particularly enforcement of claims arising from a contractual relationship with you.

2.2   Right to information, deletion and correction

You may request information about the personal data that we hold relating to you at any time; you may also have your data deleted or corrected at any time. However, we wish to make you aware that deletion of your personal data may mean that your use of our services could be denied or restricted as a result.

You may revoke your permission for data processing at any time, with effect for the future.

However, please note that we are subject to statutory retention periods in respect to certain data. We are obliged to retain such data until the expiry of the statutory period. We store this data in our system and use it solely to fulfil our statutory retention obligations.

Requests for information on, deletion of or correction to your personal data held by us must be made in writing as stipulated by Article 14 of the Swiss Code of Obligations and sent to the address of the service provider/operator of the website referenced in the Legal Notice.

Please note that information can only be provided and requests for blocking and/or deletion processed once you have adequately identified yourself as a user of our website and upon sending us the IP address used to access the website together with the request for information, deletion and/or correction.

3    Data security

Pitsch Fitness and/or the hosting partner of Pitsch Fitness referenced in the Legal Notice takes your personal data that it has collected from the website and stores it on servers in Switzerland. Appropriate technical and organisational measures are used to protect it against loss, destruction or manipulation as well from access, amendment or distribution by unauthorised persons.

4    Cookies and web analysis tool

The website uses the web analysis service StatCounter, which is provided by StatCounter, Guinness Enterprise Centre, Taylor’s Lane, Dublin 8, Ireland.

StatCounter uses «cookies». Cookies are text files that are stored on your computer and enable the analysis of use of the website. The information generated by the cookie concerning your use of this website is generally transferred to a StatCounter server in Ireland and stored there.

This includes the following data and information:

Browser type/version
Operating system in use
Referrer URL (previously visited site)
Host name of the accessing computer (IP address)
Time of the server query

5     Social media plugins

5.1    Facebook

This website uses social media plugins from Facebook. Facebook refers to the service provided by the US company Facebook Inc. (1601 S. California Ave, Palo Alto, CA/USA).

When you access a page from our website that includes such a plugin, your browser creates a direct connection with Facebook’s servers. The content of the plugin is passed by Facebook direct to your browser and integrated by it into the website.

By the inclusion of plugins, Facebook receives the information that you accessed the relevant page of our site, even if you do not have a Facebook account or were not logged into Facebook at the time. This information (including your IP address) is transferred directly from your browser to a Facebook server in the USA and stored there.

If you are logged on to Facebook, Facebook can associate the visit with your Facebook account. 5.2   Other social media plugins

The website may contain other social media plugins, specifically from the Instagram service, which is offered by the US company Instagram LLC.

The social media plugins of other service providers are incorporated into the pages of the website as graphic files. Each time the page is accessed, the buttons of the social media service provider are loaded. This allows, in particular, the IP addresses of all website visitors and the URL of the accessed websites to be transferred to the servers of the social media services and stored there.

Such processes do not represent a disclosure of data as defined by the Swiss Data Protection Act. We would point out that as providers of the website, we receive no information on the content of data that may be transferred or its usage by providers of social media services.
